What is a cookie?
According to provision no. 229 of 8 May 2014 of the Garante della Privacy, cookies are small text files that the sites visited send to the user’s terminal (computer, tablet, smartphone, notebook, etc.), where they are stored, and which are then retransmitted to the same sites on the next visit. Two macro-categories have been identified:
- ‘technical’ cookies, i.e. those used to perform computer authentication, session monitoring and storage on sites, without the use of which certain operations would be very complex or impossible to perform;
- profiling’ cookies, through which browsing can be monitored, data on tastes, habits, personal choices can be collected, allowing the reconstruction of detailed consumer profiles. Profiling cookies can only be installed on the user’s terminal if the user has given his consent after being informed in a simplified manner.
The GDPR does not expressly regulate cookies, although Recital 30 recalls that “Natural persons may be associated with online identifiers produced by the devices, applications, tools and protocols used, such as IP addresses, temporary markers (cookies) or other identifiers, such as radio frequency identification tags. Such identifiers can leave traces which, particularly when combined with unique identifiers and other information received by servers, can be used to create profiles of individuals and identify them’.
The Privacy Guarantor’s clarifications on the use of cookies were included in the guidelines published in the Official Gazette of 10 July 2021, which supplemented and clarified the indications provided in the previous Provision of 8 May 2014 aimed at “identifying the simplified procedures for providing online information to users on the storage of cookies on their terminals by the Internet sites visited”, as well as “providing appropriate guidance on how to proceed with the acquisition of their consent, where required by law”.
In computer science, HTTP cookies, or simply cookies, are nothing more than small text files that are stored on the user’s device when the user navigates on certain websites using their browser.
Cookies are useful because they allow a website to recognise the user’s device and have various purposes such as enabling efficient navigation between pages, remembering favourite sites and generally improving the browsing experience.
